Hi @joannal, I've removed some original screenshots and replaced these with redacted versions. This is just to ensure your identity is not shared. Hope that's ok.

    Yes, that's ok.

I got response from DWP. She just copied and pasted message that she sent yesterday. This is going nowhere. What shall I do next? Who is above DWP or is there a organisation that they are afraid of?

You can try making a formal complaint about

    A) the incorrect advice

    B) not getting paid your LCWRA element

Request the Mandatory Reconsideration (MR) on the decision not to start the waiting period from the date you provided your first fit note. This can be done on your journal but make sure you include the letters MR.

What was the date you handed in your first fit note? It should be noted in your journal

And what is your payment date each month?

2024. My assessment period is from 11th to 10th. I get paid on 17th

    So that looks correct

-Remember also UC is paid in arrears

So the relevant period-the months youbdont get paid for are

You award period ends bin the 12th of every month and we call it 3 assessment periods but it's actually 14 weeks

    SO

10th september-11th October is your payment for 13th august-12th September -you fit not only covers the last 2 weeks of this period

    You relevant period is

    11th October-10th November

    11th November-10th December

    11th December-10th Jan

So you are entitled to payment from 11th Jan 2025

As UC is paid in arrears you will be paid for this period on February 11th which covers the period 11th january-10thth February

    Hope that makes sense

No. My first assesment period was September/Ocrober

    2nd October /November

    3rd November/ December

These are 3 full assessment periods after submitting my first fit note.

Where can I find legislation for LCWRA? Legal acts etc?

This is not correct, the waiting period is not 14 weeks. It's 3 FULL assessment periods. @joannal has already been advised by Kimmy and myself that their waiting period is  Sept/Oct, Oct/Nov, Nov/Dec… LCWRA starts from assessment period 11th Dec to 10th Jan and first payment will be 17th Jan 2025.

Thanks, what legal act is this from?

It's the ADM which applies to UC.

If you want the UC regulations 2013 you can find what you're looking for here. It's the same as the ADM but often the regulations are more difficult to understand.
