Uc Migration notice

Hi

My husband and I both recieved a UC migration notice letter informing us that child tax credits and income support are stopping and we need to claim UC.
How does it work we claim income support , child tax credits , on full housing & council tax benefit , we are also on a rent protection scheme, we have 3 other adults in the house , 2 of whom claim pip both enhanced care, 1 enhanced mobility & 1 low mob , my husband claims pip low for both care & Mob and our child gets dla low mobility and high care. We claim carers allowance for each of our disabled non dependants (the ones whom claim pip)

How will being on UC affect us, I feel sick after receiving the letter today.

We will look into help from advisor but I know you are good here from my precious posts.

    It's scary because of fear of the unknown. You will need to make sure you claim UC by the date in the letter. Once you submit your claim then your Tax credits will end. Both of you will need to start a claim and then one of you will receive a linking code to join both claims together.

    Your IS and housing benefit will continue for 2 weeks and then stop.

    When you both claim you will need to make sure you report being carers. Your UC will then include 2 carers elements. Your carers allowance will be deducted in full from any UC entitlement. Carers allowance will then continue as normal. As carers neither of you will have any work commitments but you may both be expected to attend your local Job centre for your first appointment. After that there will be no further appointments.

    Once you submit your claim your first payment will be 1 month and 6 days later. You can request an advance payment but please be aware that this will need to be repaid back and your future payments will be reduced.

    Although your husband has a health condition, it may not be worth him reporting his health condition but it will depend on whether your UC includes any TP but I suspect it may because your IS also includes some disability premiums. If he reports his health condition and is found to have LCWRA then you may not be any better off because if you become entitled to other elements your TP decreases.

    Also as he will be claiming carers element, if found to have LCWRA then he will not be able to claim both elements. In this case the higher element will be paid, which is the LCWRA element. It really depends on the figures whether it's worth going down the work capability assessment route.

    Your council tax reduction will be recalculated based on your UC entitlement. I can't advise on that because all LAs have their own rules.

    There will be no non dependent deductions because of your husbands daily living PIP award.

    Only if he reports his health condition and provides a fit note. Claiming PIP doesn’t automatically entitle him to LCWRA. Please read back through my last comment and take note of the advice I gave.

    TP = Transitional Protection. (If entitled) Apologies, I should have typed the full word to start with.

    also with the housing benefit because we get full housing benefit at the moment should we call LA to let them know there maybe a gap in payments ?

    There's no harm in doing that once you've claimed UC. Does housing benefit pay your Landlord directly at the moment? UC is paid 1 month in arrears so please bear that in mind also.

    Are you privately renting or social housing? If privately renting when you claim UC you will need proof of liability to pay rent, such as tenancy agreement.

    If social housing then UC will contact them directly.

    Then they will contact your LL directly. You will just need to tell them who they are. They should be able to pay your LL directly.

    My daughter claims UC that includes housing element and they pay directly to our social housing LL.

    ok thank you.

    With the carers allowance I know you said the carers allowance will be deducted in full from UC does that mean it’ll stop going in bank until sorted? Obviously the carers allowance goes into my bank for my son who I claim for, will it still go into my account ? My husband claims for our other son and that money goes into his bank account, Sorry for so many questions but it’s helping my mind feel less all over the place.

    You're welcome. They will both continue as normal. You need to make sure you both report being carers when filling out the form and then your UC will include 2 carers elements.

    It's the same when claiming Income Support, carers allowance is deducted in full.

    Hello sorry me again.
    You said above that IS and housing benefit will continue for 2 weeks and then stop and once we claim UC the first payment will be 1 month & 6 days after. So as we get IS fortnightly say we have a IS payment in that 2 weeks will that mean roughly 3 weeks after we will get a UC payment if eligible? Have I understood that right? Or it does not work like that?

    We have started the claim we just need to find out our rent etc from housing.

    Does my husband have to tell them he has a disability? He gets pip low on both care & mob. He doesn’t work because he cares for our disabled son and also his medical condition makes it hard for him to work if he ever did/had to.

    You have 3 months to claim so if you've only just received the letter you have plenty of time left. I wouldn't rush it to be honest.

    As I advised earlier in the thread, you both need to report being carers and your UC will include 2 carers elements. He doesn't need to report his health condition because he's a carer and will have no work commitments anyway. He can of course report his health condition and provide fit notes but you may not be any better off by doing so. Please read back through the thread again to see all the advice I gave.
