They made MR decision yesterday, but won't tell me the outcome over the phone

    Hi Tbarber47
    May I ask when you put your Mr in and did they ring you asking more questions I scored 2 points on my assessment and put Mr in the assessor put on my report no diagnosed lower limb problems and my assessment lasted 30 mins an she said mentally I was fine even though I had someone with me that helped me and said I was shaking. She said I was fine.

    Hi kst i put my mr in 2 weeks after the decision letter said 0 points on everythink sent further evidence from xray and 2 weeks later had a call from dwp man went through some things on phone few days later he awarded and over turned it gave me standard daily living  but 0 for mobility but its first step and was lucky to get 8 points on mr i will be going to appeal the mobility side ,so in total whole process of my mr took 4 weeks and backpay was sent before decision letter  are you doing a mr ?

    Hi another question when u take it to tribunal can they take away what your already been awarded if you looking at mobility side only which i have 0 points for now im only asking for that side not what iv already been awarded on daily living?

    Yes I put in Mr about 2 weeks ago did it by phone sent copies of my mental health appointments and just sent a letter to go along with it explaining more why I disagreed. I suffer from depression have since a teenager and found out i had cancer earlier this year have had surgery and had some lymph nodes removed too. So when assessor said no diagnosed lower limb I thought it's not based on diagnoses have explained the reason I struggle with lower limbs in letter. They then says my depression meds are first line and no current specialist input I have been told to see a Councillor one on one but advised to wait as I just found out about the cancer and they thought would be too much.

    When you appeal the whole award is open for review. However if you are happy with the Daily Living award you can make this clear in your appeal and the tribunal will be unlikely to look at if unless they think there is something inconsistent between it and what you are saying about your mobility issues.

    Hi i put my tribunal appeal in today on line fingers crossed i choose not to go they text to say dwp have till 21st dec to respond question is do they respond?

    Paper based hearings have a very low success rate of between 5-8%. For this reason I would advise you to attend, this can either be in person, video or telephone hearing. 
    They don’t always respond by the deadline.

    There has been a couple of members here that have had success with paper based hearings but as i advised the success rate is extremely low. Appearing in person/telephone or video there's about a 70% success rate.

    I have, in the past prepared submissions for about 3 claimants who did not wish to attend hearings and on all occasions was successful. However by not attending a hearing you prevent the tribunal having the opportunity to ask questions to help them reach a decision.

    Hi had a message saying dwp have responded to my tribunal from tribunal appeals and i should receive a copy in post and to send any comments if i have any and next thing be the hearing they responded before deadline so what should i do now

    If you haven't already received the "bundle" you should receive that next. Once you do have you need to go through it to make sure everything is there. If you have any additional evidence other than what you've already sent then you should make sure you send that to arrive at least 2 weeks before your hearing date.
    Once that's done all you need to do is wait for the hearing, which could be quite a few months.
