Hi @cheekylittlekoala - you didn't meet any of the LCWRA descriptors (& you only need one) or you would have been found to have LCWRA rather than LCW.So, have another look at the LCWRA descriptors here: https://www.turn2us.org.uk/get-support/information-for-your-situation/work-capability-assessment/limited-capability-for-work-related-activitythen write your Mandatory Reconsideration saying which one (or more) descriptors you feel apply to you.Give one or 2 detailed examples as to what happened when you attempted to do one (or more) of these, or if you can't do them explain why.1

According to Citizen's Advice, when you challenge the decision:To ask for a mandatory reconsideration you can:- write a message in your Universal Credit online account, if you have one
- use the CRMR1 mandatory reconsideration request form on GOV.UK - you'll need to download it and fill it in, then print it off and send it by post
- write a letter or call the DWP - check the contact details on your decision letter
It's usually better to use your Universal Credit account, fill in the form or write a letter. This means you can keep a record of why you disagree with the decision and prove you asked for it to be looked at again.
But when I searched for how to in Belfast I am afraid I hit a brick wall. I am unsure if it is the same procedure. I would suggest reaching out to Citizen's Advice for further clarification.
I'm not in Belfast but the Service Centre that contacted me was.
I have contacted CAB as i have no idea what i am doing or writing. Too stressed out right now.
Kind Regards0 -

I will read through the descriptors again and find which one best suit me.

This is the reply i got from CAB:Thank you for your email. Have you had a response to your mandatory reconsideration? We can help you appeal, but only when you get the mandatory reconsideration notice (you will have 1 month from the date of this letter to challenge it).I am not understanding what they are saying.0

They didn’t overturn my MR and still found me to be LCW and basically didn’t believe any of my new information and went with the lying practitioner!! My Dr told them a load of rubbish as well. Is it worth going to tribunal or just leaving it? I am not happy and i feel like real rubbish.0
-
Also i only uploaded my additional information yesterday morning, so how could they have made such a quick decision? Seems to be a bit of a farce to me!! 😡0

Hey @cheekylittlekoala, sorry to hear the MR wasn't successful. I am unsure on the rate of successful UC tribunal appeals, but if it's anything like PIP tribunal appeals there's a very good chance. It can be a stressful process though so I highly recommend you look for support in preparing for it.
Remember you called CAB before and they said they could help you once you got a reply about your MR? Now is the best time to contact them to see about getting help with the appeal. Citizen's Advice also have a help page about UC tribunals but I highly recommend speaking to CAB so they help you every step of the way.
We'll still be here rooting for you, and if you are unsure on something and can't contact CAB for some reason we are also here to try and find you an answer0 -
I have made contact with CAB and they are going to help me. I sent them my MR and just waiting for a telephone appointment.
Fingers crossed.0 -
Excellent result there @cheekylittlekoala! Please keep us updated and get in touch if you need any further support.
Keeping everything crossed for you.0 -
It feels horrible having to take the benefit system to court, but if thats the only way we have to stand our ground, so be it!!0
-
I totally get that feeling @cheekylittlekoala , I've been to tribunal twice now and both times they've had a happy ending. I know it's not always like that, but a 70% success rate says so much about the system. You got this!0

I got a phone appointment with CAB but not for another week, i asked if i need to do anything in the mean time and they said no. Surely i could be doing something as this is a Tribunal i am working towards.
kind regards0 -
Your Tribunal hearing could be another several months at least (potentially longer) so no, you do not need to do anything else right now. (assuming you've requested the Tribunal already)If you haven't yet requested it then you can go ahead and do that while you wait. https://www.citizensadvice.org.uk/benefits/universal-credit/problems-with-your-payment/appealing-a-universal-credit-decision-at-a-tribunal/You should also make sure you request either to appear in person or have a video/telephone hearing because either of those will give you the best chance of a decision in your favour.

Am i supposed to do this now or wait for CAB appointment?0

Fingers crossed!0

DWP still haven't acknowledged my appeal, what happens now? Are they preventing me from getting a hearing date?
Kind regards

Hey @cheekylittlekoala, there are ways to track the status of your appeal. Citizen's Advice lists them here, it can depend if you submitted your appeal online or via post.
The DWP has 28 days to respond to HMCTS once the appeal is submitted, and then the HMCTS sends their response to you. Some time can pass between HMCTS receiving it and passing it onto the DWP and the DWP responding and HMCTS sending you the response. I would recommend trying to contact HMCTS using one of the methods in the page I linked to see what stage you are at.1 -
It's not unusal for DWP not to respond by the deadline given by HMCTS. They will extend that deadline. DWP will eventually respond but even if they don't (unlikely) your hearing will still continue as normal. It will not prevent you getting a date for the hearing. Though this could be as long as several months. It's not a quick process.
