LCWRA Both Parents & Carers Element
Hi. Myself and my partner have had alot of changes around our family this year. At the start of the year we were both awarded LCWRA.
Then our teenage daughter was seperatley awarded DLA High Rate component for care. We now get the Child Disability payment.
However I look after our daughter for more than 35 hours per week, but it looks like you cannot apply for the carers element if you get LCWRA, What about if you both get LCWRA? does that still mean you can get the carers element?

When both of you have LCWRA you will only receive one element per claim as you know.
In your case you can claim carers element. This would mean your UC will include one carers element and one LCWRA element.
What the rules mean is that the same person can’t be paid both LCWRA and carers element at the same time.

Oh my goodness me, one day they may know their own rules. Yes, on your claim you both have LCWRA BUT only one of you receives the extra money for that because it's 1 element per claim. For this reason one of you can claim carers element, while the other receives the LCWRA element.

Put a message in reply to that and tell them that because 2 LCWRA elements can't be paid on the same claim, you are only receiving 1 LCWRA element. This means that 1 person can also receive the carers element.

very helpful - thank you for taking the time to reply. We have had so many changes lately to our circumstances and the journal entries take ages/ they always seem to reply with the wrong answer then I end up ringing to correct it. Thanks again .
