PIP decision explanation/Mandatory Reconsideration Notice
Hi folks
I have MS and have been awarded basic rate mobility scoring 10/12 points for moving around.
I have not received enough points for daily living as I only received 6 points. I thought I had described my difficulties much better but obviously not.
Any advice appreciated.
Do I ring and ask for a full report?
Can I ask for an extension? My letter was dated 31st Dec but I didnt receive it until 8th Jan.
What is the best way to do this?
Please help.
Janice

You can ring to request the report but it’s not needed to request the MR.
You do not need to ring to ask for extra time because you have 13 months to request it. If you’re outside of the 1 month timeframe you will need to tell them why you didn’t request it within the first month. If they refuse you just proceed to Tribunal.
You should put the request in writing stating where and why you think you should have scored those points. Please do not ring to request it.

Thank you Poppy
I was advised to ring tomorrow to request the full explanation plus an extension. This was from my local Councillor. The date on my letter is 31st Dec although I didnt receive it until 8th Jan so I am starting to panic about timescales.

This is why a local Councillor should be the last person you ask for benefits advice. You do not need an extension to request the MR. As I advised, you have 13 months.
Once you ring PIP and mention the work MR your time starts ticking and a decision could be made at anytime. Which means they do not have to wait for you to send them a letter.

So I just write requesting a MR stating why I think the decision is incorrect?
Sorry Im just scarred of doing the wrong thing.
Thanks

You need to state where and why you think you should have scored those points. You can't do the wrong thing. Just make sure the information you give is relevant to the descriptors and how your conditions affect you. There's no specific wording you need to use.

I can understand being concerned about doing the wrong thing @JanMcD! It's okay though, you're doing the right thing by asking around and finding that information. I can understand thinking there is a short deadline and you have to request an extension because that is roughly how applying for PIP in the first place works. For the MR however you are given 13 months, they simply ask for a reason why it was not within the first month if it is later. The letter arriving late is certainly a valid reason that would delay the completion of your MR.
As Poppy mentions, see what the decision says and write why it is wrong. If it says you don't need help making food but you actually do then write in the MR that you need help, what sort of help you need, why you need that help, what happens if you don't get that help, and how it affects the rest of your day. All of these points can help show how you meet the descriptors.

Thank you so much.
Do I need to request the full report on why they came to the decision or is the short report enough?
Thanks again 🙂

As advised earlier in the thread, you don’t need the report to write the MR letter.
