Oh I just remembered I asked for a MR on the backpay but kept getting put through to payments as they said it’s a payments issue. I’m so confused now!!!!!

Hi everyone to everyone who have got the backpay WELL DONE. I’m really frustrated and tbh the pip people on the phone got me down for a few days . I made a call and was told I was not entitled to the backpay but surely I do. I was awarded the standard rate daily living in 2020 and received a letter dated the 15th stating I was still on the standard rate of daily living and the enhanced rate of motability from 2020 but my claim had been extended to December 2024. 5 days later I received another letter and to my surprise I was awarded the higher rate daily living. I forgot to mention that before the MM I had scored 11 points and on question 9 I was given the full 4 points instead of the 2 taking me to 13 points hence the enhanced rate. However my backpay from November 1st to the 29th 2023 made no sense and I called the pip helpline. After speaking to 3 different people and being passed around for a few hours I was told I was not entitled. I missed a call the day before yesterday so I called back only to be told my claim had been looked at and was right. I felt betrayed as the MM decision applies in my case. Anyway I got another call yesterday and I missed it again. I’m so overwhelmed I haven’t called back. What should I do? Any suggestions??? I keep reading posts of people getting their backpay which is awesome but what do I need to do??? Please somebody help me….

The reason you're not getting very far with this is because this review you had is not related to the changes to this descriptor and your previous award will not be looked at.

It will be a different team known as the review team as part of the "administrative exercise" that will need to look at your previous decision again. Which is why i'm not surprised you've been told you're not entitled to it by those you spoke to.

They may even send you a letter to ask for more information, which i have seen a couple of threads on here related to this. You need to wait until they contact you.

Ringing the PIP helpline isn't going to help you because they are call centre staff and probably will not know much, if anything at all about this. Please see link. https://www.disabilityrightsuk.org/news/2020/september/dwp-launches-case-trawl-review-exercise-identify-pip-claimants-owed-benefit

Please may i ask if the decision that was made in 2020 was made by DWP or a Tribunal?

There was also updated information from Benefits and work on this last month. You can read it here. https://www.benefitsandwork.co.uk/news/quarter-of-a-million-pip-claimants-may-still-be-owed-thousands-in-back-payments

You can't challenge the decision for your previous award because you're out of time for that now, as it's been more than 13 months. I advised you that on a previous thread.

That's impossible to answer, i'm afraid.

Ok I will call them and let you know but you think they will look in to my MM judgement based backpay and I should just wait or put an MR on this decision because of the packpay???

@sammyc37 did you get anywhere with it by any chance? I got a letter about it this year when I was awarded 4 points and contacted them. Waiting to hear from the LEAP team now.
