Hi
I hope you are all well. Will my 18 soon to be 19 year old mentioned above be able to claim UC himself now we’ve told UC about him and his education ending? In our journal on the message we received from them it said once we make the change he can apply himself , thing is he will need help from me or his Dad as he’s isn’t good with understanding or receiving and comprehending information or dealing with money etc, so could we help him? My husband is his appointee at the moment.
Spent another night worrying over this.

Yes, he will be able to claim UC in his own right if the child element has ended. The only issue you may have is if he returns to college in Sept because full time students and UC do not mix. If he returns in Sept you must report the changes.
As your husband is his appointee then he will be able to start a UC claim as if he's your son or you can do as if you are him. Please make sure that when answering the questions that you give your son's information and not yours or your husband's.
You will need to make sure you report his health condition and provide a fit note within 7 days of that. You will need to continue to provide fit notes until a decision is made on his work capability assessment. (WCA)
As he lives with you he will not be able to claim for help with any rent. He will be entitled to standard allowance (under 25) £311.68/month. If found to have LCWRA then that will increase by £416.19/month.
Up until recently being an appointee for someone claiming other benefits wouldn't transfer across to UC so you would have needed to go through that process again. Very recently I found out that the appointee should now automatically transfer to UC but please put a message on his journal and mention being his appointee for the disability benefit he's claiming. As his appointee he should have no work commitments.

That's good to hear. To be honest based on the information you gave I wouldn't expect you to have any further payments for your son, even if he returns to full time education because it's not a qualifying education for child element to continue.

Ok so the level 3 diploma non advanced education college course & GCSE maths is not eligiable for child element anymore?

Ah apologies, completely forgot it's level 3 non advanced. I advise so many people I do sometimes get confused from one person to another. That would be a qualifying course but for you child element will end due to his age on 1st September. (depending on assessment period dates this could be sooner) I remember now that he's not sure if he's returning is September.
You may want to wait to see if the element is included for him. What date do you usually receive your money?

If he did go back to full time education would we get child benefit until he is 20?

Thank you. That means you will receive that final payment on 11th August if he decides to remain in full time education.
Child benefit will continue if he remains in full time education until the day before he reaches 20. However, that will stop if he claims UC in his own right.

If our son applies for UC and tells them about his disability will he automatically need to have a work capability assessment? Are GPs good for helping give ‘fit notes’ ?

Sorry for the delay in replying. I've been so busy all day today and not long came back online.
A fit note is what was known as a sick note so yes a GP or consultant or a nurse can provide one.

Ok thank you. So do we ask the GP for fit note for our son due to him going on UC? He ain’t ask himself unfortunately

I hope you are all well.
To help my mind I have printed out a uc50 form so I can complete it to the best of my ability for my son as if I was him so then I know what I need to do when it comes to it, is it write I can complete a form online but print it off after I’ve typed it up?
I am someone who likes to be prepared especially in my head, I know it’s an extra thing to do but if it makes me feel less stressed I’m happy to have completed a practice form.0 -
Yes you can do that but please make sure you do not return the form until you've received that form in the post. If you return it before that then it will be ignored.

Yes I understand , I just wanted to get organised in my head if anything to be honest.
Just so I have it straight in my head, we will help our son make a claim for UC in his name, where it says do you have a disability we tick it?

the thing he will need help with is instructions being given to him slowly and in short sentences & to be shown what to do a few times until he feels he can remember how to do the job, he also won’t be able to lift heavy objects and will need access to a toilet quickly, there’s other things but that’s just a few things he will find hard.I know I’m being annoying I just want to have it in my head so we can best support our son in the next journey, I appreciate everything you help with 🙂
